A Home and Community-Based Services (HCBS) waiver — also called a 1915(c) waiver after the section of the Social Security Act that authorizes them — allows states to use Medicaid funding for services that help people with disabilities, elderly individuals, and those with chronic conditions remain in their homes and communities rather than in nursing facilities.
Each state designs its own HCBS waivers and decides which services to include. Services commonly covered under HCBS waivers include: personal care, home health aide, adult day health, respite, home modifications, and in many states — environmental modification services like pest control when infestation creates a health or safety risk.
The 2014 HCBS Final Rule from CMS (Centers for Medicare & Medicaid Services) strengthened requirements that HCBS waiver settings be home-like, safe, and supportive — which has led more states to authorize environmental health services.
